2. Objective

4. Earnest Money Deposit (EMD) & Tender Fees
- EMD Amount: ₹5,00,000 (Five Lakh Rupees).
- Submission Mode: Through RTGS/NEFT to CEL’s specified bank account or via Bank Guarantee/Demand Draft.
- Exemption: Micro and Small Enterprises (MSEs) are exempt from EMD but must submit a valid Udyam Registration Certificate and a Bid Security Declaration.

5. Scope of Work
The selected FMC will be responsible for comprehensive program management, including:
- Training Partner Management: Onboarding, empanelment, and management of Training Partners (TPs) in alignment with project goals.
- Technology Platform: Deploying an AI-enabled platform for candidate enrollment, assessment, proctoring, audit trails, and real-time MIS dashboards.
- Compliance & Documentation: Ensuring strict adherence to NCVET and Awarding Body guidelines, maintaining audit-ready records for 10 years.
- Stakeholder Coordination: Liaising with CEL, State Welfare Boards, TPs, and other agencies.
- Monitoring & Quality Assurance: Implementing SOPs for mobilization, training, assessment, certification, and conducting scheduled/surprise audits.
- Fund Utilization Tracking: Maintaining structured expenditure logs and submitting Fund Utilization Certificates (FUC).
6. Eligibility Criteria for Bidders (Training Partners/Agencies)
The bidder (Program Management Company) must meet the following criteria:
- Experience: Minimum experience of assessing/training 5 lakh candidates under Government skill programs in the last 3 years cumulatively. Must have a team of at least 40 domain experts in construction, safety, and OSHE.
- Financial Turnover: Average annual turnover of ₹3 Crore or more in the last three financial years (2022-23 to 2024-25) with a positive net worth as of 31 March 2025.
- Certifications: Must possess valid ISO 9001:2015 (QMS), ISO 27001:2022 (Information Security), and CMMI Level-3 certifications.
- Non-Blacklisting: Must not be blacklisted or debarred by any Government/PSU agency.
- Platform Hosting: Must host the technology platform on Indian servers.

7. Selection Criteria
- Two-Stage Process: Technical Bid Evaluation followed by Financial Bid Opening for technically qualified bidders.
- Award Criteria: The bidder quoting the highest Net Revenue Share (NRS) percentage to CEL will be declared the successful bidder (L1).
- Tie-Breaker: In case of a tie, a draw of lots or other suitable method will be used.
8. Empanelment Procedure for Training Partners
- The selected FMC will be responsible for preparing a tender/RFP for the empanelment of actual training resources/partners.
- The FMC will manage the entire empanelment process, including geo-tagged verification, online approvals, and onboarding of TPs as per project requirements.
9. Eligible Beneficiaries
The program is targeted at construction workers in a North Indian state for Recognition of Prior Learning (RPL) and Bridge Training.
10. Total Target to be Trained & Job Roles
- Indicative Project Value: ₹7,99,20,000 (including GST).
- Total Target: The specific number of candidates will be defined based on the end client’s final requirements. The bidder’s past experience of 5 lakh candidates is a key eligibility metric.
- Focus Area: The training will focus on construction sector skills, including occupational safety, health, and environment (OSHE).
11. Duration
- The indicative project completion period is three (3) years, subject to variation based on the end customer’s final order to CEL.
12. Funding and Payment Conditions
- Payment Basis: Back-to-back with CEL’s contract with its end customer. Payments to the vendor will be released pro-rata after CEL receives payment from its customer.
- Payment Trigger: Submission of vendor invoice and end-user acceptance certificate.
- CEL’s Share: The contract value for the successful bidder will be the customer’s price to CEL, minus CEL’s Net Revenue Share (NRS). E.g., If customer price is ‘P’ and NRS is ‘N%’, Vendor PO value = P x [(100-N)/100].
- Other Charges: The vendor will bear all costs of bidding, BG commissions, and CEL employee TA/DA for project-related travel.
- Advance Payment: Possible only against a Bank Guarantee and after CEL receives an advance from its customer.
- Performance Bank Guarantee (PBG): Successful bidder must furnish a PBG of 3% of the total contract value within 30 days of work award.

- Bid System: Two-Packet System (Technical Bid and Financial Bid in separate envelopes).

15. Other Important Terms & Conditions
- Validity: Bid must remain valid for 180 days from the date of opening.
- No Deviations: Any deviation in technical or commercial terms may lead to outright rejection.
- Liquidated Damages: LD clauses applicable on CEL by its customer will be passed on to the vendor. CEL also reserves the right to impose LD up to 10% of PO value.
- Arbitration: Disputes will be referred to a sole arbitrator nominated by CMD, CEL, with jurisdiction in Delhi.
- Variation Clause: CEL reserves the right to vary order quantity by up to ±50% at the contracted rates.
- Force Majeure: Provisions exist for contract extension or foreclosure in case of prolonged force majeure events.
